He commenced his career as a state prosecutor. During his early years in the legal profession he was exposed to a diverse range of delictual actions and, while his initial trial experience was grounded in our criminal courts, he later shifted his focus onto civil litigation. Edeling Attorneys was founded more than twenty years ago. As the practice grew and the workload increased, Tobie van Niekerk was appointed to assist in the litigation department. This dynamic duo soon forged a partnership which laid the basis for what is now a thriving, reputable personal injury specialist firm. During the first decade of the EVN partnership, Herman headed the marketing department and expanded the scope of the firm’s litigation expertise into a variety of delictual actions including claims against Metrorail (PRASA), Common Law and Public Liability actions and Medical Malpractice suits. The growth and expansion of EVN resulted in him taking a back seat in respect of litigation, allowing him to focus more on the marketing aspects of the firm as well as managing the administration, human resources and financial departments. Herman now functions predominantly in a financial, managerial position within EVN, focusing his energies on the day-to-day running of the firm.

After completing his period of articles, he joined Edeling Attorneys and in 1998 the Edeling van Niekerk partnership was established. Heading the litigation department of the firm he soon transformed EVN into a market leader in the administration of Road Accident Fund compensation. He quickly grew and extended this personal injury specialty into the sphere of suburban rail commuter claims, as well as into the fields of medical malpractice and professional negligence. As head of both the litigation and marketing departments, he oversees the general management of the firm’s legal team. The exceptional success rate enjoyed by his team stems largely from his formulation of a highly specialised panel of medical experts and advocates whose competence and expertise complement the strengths of the litigation attorneys within the firm. He has structured the firm first and foremost around the interests of the client and this has given EVN a reputation as a firm who is willing to fight difficult matters which, from a risk perspective, few other firms are prepared to fight. His unwavering belief in honesty, sound trial preparation, and a practical approach to each individual matter has culminated in one of the most successful personal injury practices in the country.
He commenced his legal career in 1997 at the Road Accident Fund. The two years within the organisation gave him a solid grounding of RAF compensation and also an insight into the inner workings of the organisation. He joined EVN in 1999 and for the last two decades has practiced exclusively in the field of personal injury and insurance law. His expertise lie in delictual actions arising from motor vehicle accidents as well as incidents causing injury to commuters on our Public Rail Agency of South Africa (PRASA). He has been instrumental in the development of the law relating to PRASA liability, having obtained a number of reported judgments and laying a firm foundation for both current and future litigation against PRASA. His outstanding success rate and impeccable litigation skill culminated in his appointment as a director of the firm in 2009. He now focuses almost exclusively on insurance law including RAF and PRASA compensation, public liability actions and medical malpractice suits.
She commenced her legal career in the late nineties. For the last twenty years she has practiced in the fields of insurance, personal injury and family law. She sat on the Johannesburg Attorneys Association Committee for five years between 2004 and 2009. During this time, she was involved extensively in engagement relating to the RAF legislative changes. She also sat in regular court meetings aimed at streamlining and improving the administrative function of our courts. She held an ExCo position in a community-based animal welfare organisation for some years although practice demands saw her step down to focus on an ever expanding practice. She qualified as a conveyancer in 2008, is a CEDR accredited mediator and was in private practice for just over a decade prior to joining Edeling van Niekerk in December 2012. She remains focused on family law as well as personal injury litigation including medical malpractice, professional negligence and Road Accident Fund claims. Her empathy for her clients, strength in trial preparation and aggressive litigation style made her a welcome addition to the Edeling van Niekerk team. Spare time permitting, she continues to perform pro bono work in the animal rights/welfare arena.
